Compromises by legislators allow medical malpractice
bill to pass. It requires plantiffs’ attorneys to give
all medical providers who may be named in a malpractice suit at
least 60 days notice before the filing and mandates that
attorneys file a certificate of good faith that the claim has
merit within 90 days after filing the lawsuit. The certificate
of good faith must be based on an evaluation by an independent
medical expert, and plaintiffs and their attorneys can be
sanctioned for bad-faith filings. The governor is expected to
sign the bill into law as of press date.
